自2019年起衛福部將加強管制藥品流向，禁止藥廠販售「人用藥物」給予獸醫診療機構。從此獸醫師陷入無法使用「人用藥物」治療診治之寵物及經濟動物。後雖於動保法增訂獸醫師得使用經中央公告之人用藥物治療寵物。但因藥師團體爭取動物處方之調劑權，而反對相關藥事法之修法及上述人用藥物之公告。致使2018年農委會預告訂定「人用藥物用於犬貓及非經濟動物之使用管理辦法」至今未正式公告，而已公告之「獸醫師常使用人用藥暫列品項之參考藥品」卻於法無據。
查歐美澳各國，獸醫師無限制以「標籤外藥物使用」來處方人用藥物予寵物，僅小有限制予經濟動物。主要因國外將「人用藥物」及「動物用藥」視同藥物而以同一法律來規範。而台灣卻分屬藥事法、動物用藥品管理法來分別規範。致中央公告之人用藥物治療寵物時，該「人用藥物」仍有牴觸藥事法之情事。
因國外把獸醫師使用人用藥物視為當然，相關研究極為稀少。且至本文為止，我國尚查無有關之研究發表。故本文整理並建議藥師法、藥事法、動保法、及動物用藥品管理法應如何修法，以期達到獸醫師得比照國外使用人用藥物，同時藥師得取得「動物用藥」處方調劑權之目的，供各界參考。

Most major foreign countrues allow veterinarians to use human drugs by "off-label". They regulate human and animal drugs by the same law. However,Taiwan reguate those drugs separately by the Pharmaceutical Administration Law (PAL) and the Animal Drug Administration Law(ADAL). Therefore, in the notice to the central government, when vet use drugs to treat pets, the "human drugs" still violate the PAL.
Because veterinarians use human drugs as a matter of course abroad, relevant research is extremely rare. And as of this article, my country has not yet found any relevant research published. Therefore, this article organizes and recommends how the Pharmacist Law, PAL, Animal Protection Law, and ADAL should be amended, so as to achieve the purpose of veterinarians can use human drugs in comparison with foreign countries, and at the same time, pharmacists can obtain the right to adjust prescriptions for animal drugs.
