臺灣博碩士論文加值系統

台灣目前醫療傷害之受害者僅限醫療疏失之侵權賠償，對於因醫療風險之救濟、及醫療無過失之補償等則未有相當的法律來補償及救濟此等醫療傷害之受害者。因而造成許多因醫療傷害之社會問題困境。
本文首先探討台灣目前之困境，並分析此類民法之侵權責任及危險責任、刑法、醫療法過失責任、及消費者保護法之無過失責任等之責任歸屬。同時就過失之損害侵權賠償責任、國家責任、醫療責任保險、及無過失責任賠償責任等加以探討，以尋找出最佳之解決方案。
本文並分析美國、紐西蘭、瑞典、芬蘭、英格蘭、及澳洲等歐美澳國家目前對於醫療無過失責任補償制度之現況，以作為台灣擬定新的解決方案之參考。本文詳述目前審議中之「醫療事故預防及爭議處理法」草案之立法精神，認為其類似美國提供獎金來鼓勵醫病雙方達成協議，屬有限解決之補償辦法制度。如醫療提供者自認並無醫療過失而無法達成協議時，問題又回原點而只能訴之法院請求醫療過失之侵權賠償，完全無法達到醫療無過失之補償。
本文認為最佳之醫療無過失責任補償制度應放棄目前「醫療事故預防及爭議處理法」草案，另訂比照全民健康保險制度方式，成立強制醫師業務責任保險之醫療補償處，始能兼顧醫療過失及無過失之所有補償。

At present, victims of medical injuries in Taiwan are limited to tort compensation for medical negligence, and there is no any no-fault compensation of medical injury by law.
This article first discusses the current predicament of Taiwan, and analyzes the tort liability and dangerous liability of this kind of civil law, criminal law, medical law negligence liability, and consumer protection law's no-fault liability. At the same time, it discusses the liability for damage tort due to negligence, state liability, medical liability insurance, and liability for no-fault liability in order to find the best solution.
This article also analyzes the current status of the medical no-fault liability compensation system in the United States, New Zealand, Sweden, Finland, England, and Australia, etc., in order to serve as a reference for Taiwan's new solutions. This article details the legislative spirit of the draft "Medical Malpractice Prevention and Dispute Resolution Act" currently under review, and believes that it is similar to the United States providing bonuses to encourage the medical and sick parties to reach an agreement, which is a limited settlement compensation system. If the medical provider admits that there is no medical negligence and cannot reach an agreement, the problem returns to the original point and can only be appealed to the court to request for tort compensation for medical negligence. It is completely impossible to achieve medical no-fault compensation.
This article believes that the best medical non-fault liability compensation system should abandon the current draft of the "Medical Malpractice Prevention and Dispute Resolution Law", and set up a medical compensation office based on the national health insurance system to establish a medical compensation office for compulsory physician business liability insurance, so that medical negligence can be considered. And all compensation without fault.
