本研究旨在提供企業專利訴訟策略獨特的解釋和作出客觀的建議，尤其針對專利訴訟是基於337條款調查 - 公認的有效工具，以來確保企業的排他性並維持獲利。本研究收集、分析2007年中至2012年在美國國際貿易委員會所有的專利侵權訴訟，並與以往文獻做比較。然後，提出一組變量和這組變量間的定量關係所構成的數學模型來代價值判斷過程。雙向運用實證觀察和經濟模型理性闡明專利權人與被控侵權者的行為和反應 - 如何最大化效益與最小化風險。因此，本研究歸納出美國國際貿易委員會的法庭進行專利訴訟時的具體論點，以企業的層次來提出明確的建議以便做出經濟的決策。

The study aims at providing distinct explanations and making objective recommendations on Corporate Patent Litigation Strategies under Section 337 Investigation which is commonly recognized as an effective tool to maintain exclusivity and thereby protect profit margins. In this study, all cases of patent infringement litigations initiated from mid-2007 to 2012 at the United States International Trade Commission (USITC) have been collected, examined, and compared with previous literatures. Then a mathematical model has been proposed to represent economic processes by a set of variables and a set of quantitative relationships between them. The bilateral utilization of the empirical observations and economic model rationally justifies the actions and responses of patent holders and accused infringers how to maximize the benefit and to minimize the risk. As a result, the study induces reasoned arguments while patent litigations taking place at the venue of USITC and presents articulate advice at the level of corporate for economic decisions.
