科技進步使得資訊無遠弗屆，只要透過網際網路，便可以隨處獲取資訊，因網路所帶來的便利性，使許多智慧結晶暴露於盜用的風險之中，為了防範智慧結晶遭有心人士盜用，「專利」就顯得具有相當程度地重要性。專利被企業視為企業競爭力之一，部分企業運用專利鞏固企業地位，亦運用專利進行攻防戰，使競爭對手不敢貿然侵犯，而近年來，專利侵權案例與日俱增，各企業越來越重視專利所帶來的影響，正向的影響如帶給企業研發技術上之競爭力，負向影響如敗訴後龐大的賠償金，及因侵權關係被迫退出競爭市場之情形。在過去研究較多在探討賠償金、法律關係等部分，較少研究在探討「遞移性」之理論於專利侵權上，故本研究運用社會網絡分析探討電子業各企業間專利侵權之關係是否存在遞移性效果。研究結果發現，以總體性來探討，研究樣本會受到時間的影響，產生遞移性之現象，但個體部分無遞移性之現象，代表在控告三方中，第三方不會因為第一方控告第二方而亦對第二方進行提告；另外，一間企業若同時對多個企業進行提告，在下一個期間沒有發生被其他企業進行反告之情形；以及僅少數企業會進行互告行為，多數企業為單方控告；國家部分僅美國與日本會對自己相同母國之企業進行提告，其他國家皆未發現此情形。

Because of the technology is developed, anyone can get the information very convenient. But there have a risk of being stolen in the Internet. Therefore the “Patent” is becomes very important. Recent years, the case of patent infringement is increasing, more and more enterprise attention to the patent to bring effect of impact. Such as R & D technical of positive effects to bring the enterprise have competitive, or pay the compensation cause the negative effects and lose the advantage. In the past research, the more study is discussion the compensation, legal. Fewer study explore the theory of transitive in the patent infringement, this study using the social network analysis to discussion the electronics industry in patent infringement whether exist the transitive effect. The study results displayed that the study sample have the effect of transitive on the part of time in the totality. In the individual, the study results haven’t phenomenon of transitive effect. Represent that the third party will not because the first party to sue the second party, also to sue the second party. In addition, if an enterprise is sue the several other companies on the same times, the enterprise will not happen the accused situation in the next period. And only a few companies will sue with each other, the majority of enterprises is unilaterally sue. Finally, only the United States and Japan will be sue the other companies even they is same country. Other countries does not appear that situation.
